SERVICE AGREEMENT
Effective Date: December 16, 2025
This Service Agreement ("Agreement") is entered into between the customer ("Customer", "You", "Your") and Curb Glow LLC ("Curb Glow", "We", "Us", "Our"), a car care service provider operating in Boston, Massachusetts. By subscribing to, booking, or using Curb Glow's services, You acknowledge that You have read, understood, and agree to be bound by all terms and conditions set forth in this Agreement.
1. SERVICES PROVIDED
Curb Glow provides light exterior curbside car care services for street-parked vehicles, including but not limited to:
• Debris removal (leaves, twigs, branches)
• Pollen and dust wipe-downs off windows
• Window and mirror cleaning (streak-free exterior cleaning)
• Light touch-ups to door handles, panels, and lights
• Use of eco-friendly, environmentally safe cleaning products
2. SERVICES NOT PROVIDED
Curb Glow does NOT provide the following services:
• Full vehicle detailing or interior cleaning
• Entering or unlocking vehicles
• Removal of hazardous materials
• Ice or snow removal
• Under-vehicle or engine bay cleaning
• Waxing, polishing, or paint correction services
3. PARKING AND ACCESSIBILITY REQUIREMENTS
Customer agrees to ensure that their vehicle is:
• Legally parked in a designated parking area
• Safely accessible for service personnel
• Not located in an active tow zone, loading zone, or restricted area
• Not obstructed by barriers, vehicles, or other impediments. If the vehicle is inaccessible or illegally parked at the scheduled service time, Curb Glow reserves the right to reschedule the service at no additional charge. No refunds will be issued for services that cannot be completed due to Customer's failure to comply with parking requirements.
4. SUBSCRIPTIONS, BILLING, AND CANCELLATION
4.1 Subscription Plans: Curb Glow offers monthly subscription plans with automatic renewal. Current plans include:
• The Plan: $59/month for 2 services per month
4.2 Billing: Subscription fees are charged monthly on the anniversary date of Your initial subscription. Payment is processed automatically via the payment method on file.
4.3 Cancellation: You may cancel Your subscription at any time by providing written notice via email to hello@getcurbglow.com. Cancellation will be effective at the end of the current billing period. No refunds will be issued for unused services within the current billing period.
4.4 Service Credits: If Curb Glow is unable to complete a scheduled service due to circumstances
within Our control, You will receive a service credit to be used within the following billing period. Unused services do not roll over to subsequent months.
5. WEATHER, DELAYS, AND RESCHEDULING
Services may be delayed or rescheduled due to inclement weather conditions including but not limited to rain, wind, snow, extreme temperatures, or other unsafe working conditions. Rescheduling due to weather or safety concerns is provided at no additional charge and does not affect Your monthly service allocation.
6. PHOTO DOCUMENTATION AND PRIVACY
Curb Glow may take before and after photographs of Your vehicle for internal quality control, training, and customer service purposes. These photographs will not be shared publicly without Your express written consent. By agreeing to this Agreement, You consent to such photography. All photos are stored securely and are subject to Our privacy practices. You may request deletion of Your photos by contacting hello@getcurbglow.com.
7. SERVICE EXPECTATIONS AND LIMITATIONS
7.1 No Guarantee of Perfection: Curb Glow provides a light exterior refresh service only. We do not
guarantee the complete removal of all debris, residue, stains, or imperfections. Some marks,
discoloration, or buildup may require professional detailing services beyond the scope of Our offerings.
7.2 Limited Warranty: We will perform the service as described in this agreement in a timely, workmanlike, and professional manner in accordance with generally recognized industry standards for similar services.
7.3 DISCLAIMER OF OTHER WARRANTIES: EXCEPT AS SET FORTH IN SECTION 7.2, CURB GLOW MAKES NO WARRANTIES. ALL OTHER WARRANTIES, EXPRESS AND IMPLIED, ARE EXPRESSLY DISCLAIMED.
7.4 Customer Inspection: Customer agrees to inspect their vehicle within 24 hours of service
completion. Any concerns or issues must be reported to Curb Glow within this 24-hour window by
emailing hello@getcurbglow.com or texting the service notification number. Claims reported after 24 hours may not be addressed.
7.5 Remedies: If you notify us of any concerns or issues within 24 hours of service, Curb Glow shall, at its discretion, either use commercially reasonable efforts to promptly address those issues or issue You a service credit to be used within the following billing period. This is Your sole remedy and Curb Glow’s sole responsibility in the event of any breach of the limited warranty set forth in Section 7.2.
8. CUSTOMER RESPONSIBILITY FOR VEHICLE CONDITION
You are responsible for ensuring that Your vehicle's exterior condition is suitable for light cleaning
services. Customer agrees to notify Curb Glow in advance of any of the following conditions:
• Aftermarket paint, wraps, or vinyl decals
• Loose trim, molding, or body panels
• Sensors, cameras, or sensitive electronic components on exterior surfaces
• Pre-existing rust, chips, scratches, or paint damage
• Custom or delicate finishes requiring special care
Curb Glow is not liable for damage arising from, or worsening of, pre-existing conditions, loose
components, aftermarket modifications, or failure to disclose such conditions.
9. LIMITATION OF LIABILITY
9.1 Maximum Liability: To the fullest extent permitted by Massachusetts law, Curb Glow's maximum liability for any claim, damage, or loss arising from or related to Our services shall not exceed the total amount paid by Customer for the specific service giving rise to the claim, or $100, whichever is less.
9.2 Exclusion of Consequential Damages: Curb Glow shall not be liable for indirect, incidental,
special, consequential, or punitive damages, including but not limited to loss of use, loss of profits, or inconvenience, even if advised of the possibility of such damages.
9.3 Exclusions from Liability: Curb Glow is not responsible for:
• Pre-existing damage, wear, or defects to the vehicle
• Environmental effects (tree sap, bird droppings, pollen, road salt, acid rain)
• Damage to interior components (Curb Glow does not enter vehicles)
• Electronic systems that activate during exterior service (alarms, sensors, cameras)
• Theft, vandalism, or damage by third parties
• Damage caused by Customer's failure to disclose vehicle conditions per Section 8
9.4 Insurance: Curb Glow maintains commercial general liability insurance. Proof of insurance is
available upon written request.
10. INDEMNIFICATION
Customer agrees to indemnify, defend, and hold harmless Curb Glow, its owners, employees, agents, and contractors from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:
• Customer's failure to comply with parking or accessibility requirements
• Unsafe or illegal parking conditions
• Environmental hazards near the vehicle
• Interference by third parties (including pets, pedestrians, cyclists, or other vehicles)
• Customer's misrepresentation of vehicle condition or failure to disclose relevant information
11. DISPUTE RESOLUTION AND ARBITRATION
11.1 Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Boston, Massachusetts, administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
11.2 Small Claims Court Exception: Either party may bring an individual action in small claims court
in lieu of arbitration if the claim qualifies.
11.3 Costs: Each party shall bear its own costs of arbitration unless otherwise determined by the
arbitrator in accordance with applicable law.
11.4 Class Action Waiver: All claims must be brought in the parties' individual capacity, and not as a
plaintiff or class member in any purported class or representative proceeding.
12. COMMUNICATIONS
Customer consents to receive communications from Curb Glow via text message, email, or phone for purposes of scheduling, service updates, billing notifications, and promotional offers. Customer may opt out of promotional communications at any time by replying "STOP" to text messages or clicking "unsubscribe" in emails. Opting out of promotional communications will not affect service-related notifications.
13. MODIFICATION OF TERMS
Curb Glow reserves the right to modify this Agreement at any time. Material changes will be
communicated to Customer via email at least 30 days prior to the effective date of the change.
Continued use of Curb Glow's services after the effective date constitutes acceptance of the modified terms. If You do not agree to the modified terms, you may cancel Your subscription as provided in Section 4.3.
14. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.
15. SEVERABILITY
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining
provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between Customer and Curb Glow regarding the
subject matter hereof and supersedes all prior or contemporaneous understandings, agreements,
representations, and warranties, both written and oral.
17. FORCE MAJEURE
Curb Glow shall not be liable for any failure or delay in performance due to circumstances beyond Our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, labor disputes, or utility failures.
CUSTOMER ACKNOWLEDGMENT AND AGREEMENT
By subscribing to or using Curb Glow's services, Customer acknowledges that they have read,
understood, and agree to be bound by all terms and conditions of this Agreement. Customer
specifically acknowledges and agrees to the following:
1. Services are limited to light exterior cleaning only
2. Curb Glow does not move, enter, or unlock vehicles
3. Pre-existing damage or defects are not the responsibility of Curb Glow
4. Environmental effects are not covered under any warranty or guarantee
5. Customer must inspect vehicle within 24 hours and report concerns promptly
6. Customer agrees to notify Curb Glow of sensitive paint, wraps, or aftermarket features
7. Disputes will be resolved through binding arbitration in Boston, MA
8. Liability is limited as set forth in Section 9
